1 General Terms & Conditions

Ksiazka.uk website and services are provided by Qart Limited, with registered offices at 8 Jordanvale Avenue, Glasgow, G14 0QP, United Kingdom. In these conditions “Ksiazka.uk”, “we, “us” or “our” shall be construed accordingly.
Ksiazka.uk sells our products to you subject to the Terms and Conditions set out in this document. We may amend these Terms and Conditions at any time by giving you notice either by email or by posting of the amended Terms and Conditions on our website www.ksiazka.uk. Any new features or tools which are added to the current shop shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Please read these Terms and Conditions carefully. By using this service you signify your agreement to be bound by these Terms and conditions. These Terms and Conditions operate within the Consumer Protection (Distance Selling) Regulations 2000.
1.2 Contract Conclusion
Ksiazka.uk specialises in the sale of Polish books, audiobooks, board games, toys and stationery products. If you submit an order to us via this site by clicking ‘Submit Order’, your order is an offer to us to buy the goods on our website under these Terms and Conditions.
We will send you an automatically generated e-mail accepting your order. The contract will relate to only those goods which are referred to in our e mail confirmation of acceptance of your order. You should read and check these details carefully to ensure that they are correct. If the details are not correct, please contact us immediately via e-mail. A breach or violation of any of the Terms will result in an immediate termination of your Services.
1.3 Availability and Delivery
Information displayed on the website relating to availability is subject to change without notice. We cannot guarantee permanent or continuous availability of all products on this site. All orders are subject to availability at all times.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e mail and/or billing address/phone number provided at the time the order was made.
1.4 Liability
Should the print, stationery or merchandise goods that Ksiazka.uk delivers be defective, damaged, not what you ordered, or of incorrect quantity then you have a statutory right to cancel with refund of monies paid. You must notify us in writing within fourteen working days after receiving your goods, beginning with the day after receiving your goods. Unless you notify us in writing within seven working days of receipt of goods Ksiazka.uk will hold no liability. Upon notifying Ksiazka.uk under this condition our only obligation will be to supply any shortfall of goods on a delivery or non-delivery, to replace or repair faulty or damaged items; or to refund you the amount paid for the goods in question to the original method of payment.
Ksiazka.uk will where possible ensure that the availability of Ksiazka.uk services will be un-interrupted and remain error-free. Due to the nature of the internet this cannot be guaranteed but we will do our utmost to restrict access for repairs, maintenance or site updates infrequently and for short durations. It is your responsibility to implement appropriate IT security safeguards (including anti-virus checks) to satisfy your particular requirements as to the safety and reliability of using the website.
Ksiazka.uk does not warrant that the material on the website is completely accurate and will have no liability in respect of such material. Information regarding goods and their availability is subject to publisher information and stock levels. We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
Nothing in these terms will affect any liability we have: (a) fraudulent misrepresentation; (b) for death or personal injury arising from our negligence; (c) under Part 1 of the Consumer Protection Act 1987; (d) for breach of any condition as to title or quiet enjoyment of or in relation to any goods supplied by us; (e) in relation to any other liability, including any liabilities under sale of goods or supply of services legislation, that may not be by applicable law excluded or limited.
1.5 Use of Third Party Services
When you use Ksiazka.uk you may also be using the services of one or more third parties, such as wireless or mobile providers. Ksiazka.uk accepts no responsibility for any person who is not a party to these Terms and Conditions under the Contracts (Right of Third Parties) Act 1999. However, your use of these third party services may be subject to separate policies or terms of use or fees dictated by said third party.
1.6 Complaints
Ksiazka.uk operates a complaints procedure. Any complaint should be made in writing to our Customer Services Department: Customer Service Department, Ksiazka.uk, 8 Jordanvale Avenue, Glasgow, G14 0QP, United Kingdom, or via e-mail on ksiazka@ksiazka.uk. We aim to respond to a complaint in writing within 28 days.

All content included in and made available through Ksiazka.uk, such as images, text, logos, graphics, icons, electronic downloads, multimedia or audio content is the property of Ksiazka.uk or our content suppliers and is thus protected by all applicable national and international trademark service marks, copyright and other intellectual property laws, rules and regulations. You may not extract or re-use any content from Ksiazka.uk for any reason without express written consent from Ksiazka.uk. You understand that copying, mining or extracting data or content found on Ksiazka.uk or downloaded through Ksiazka.uk, for any reason or purpose, without permission from its owner, may constitute an infringement of intellectual property law(s) or regulations.
1.8 Pricing
Ksiazka.uk uses all reasonable endeavours to reflect the most accurate information regarding book prices at all times. We cannot guarantee our ability to supply any particular book.
All prices are displayed in pounds sterling (£) on our website and are inclusive of any relevant VAT. By committing to purchase you are agreeing to pay the price of the goods you have ordered.
2 Conditions of Sale
2.1 Value Added Tax
Unless stated otherwise, all book, stationery or merchandise prices displayed on Ksiazka.uk are inclusive of UK VAT at the current rate. Delivery cost will be notified to you separately before placing your order at the check-out area of the website.
If you require further information on VAT distance selling rules please contact your relevant VAT authority who can provide specific advice for your locality.
2.2 Privacy
Ksiazka.uk and all transactions are governed by the Data Protection Act 1998. Please review our Privacy Policy for further information about using our site. Our Cookie policy also further explains our cookie practices further. We will use your personal information in accordance with our Privacy policy which forms part of these terms.
We commit to store securely, any information given to Ksiazka.uk and assure customers that information is not accessible to others. Ksiazka.uk will not circulate any data to anyone outside of Ksiazka.uk, the Qart Limited Group or affiliated partners without express permission.
2.3 Security of Payment
Ksiazka.uk uses the highest level outsourced systems of security around our payment and order processes so that your personal information and payment details are kept secure. This information is protected by the Data Protection Act 1998 and complies with the Payment Card Industry Data Security Standards and Regulation 4 of the Consumer Rights (Payment Surcharges) Regulations 2012.
2.4 Refunds and Returns- Books, Stationery and Merchandise
You have a statutory right to a refund on book, merchandise and stationery products if for any reason you are unhappy with these products purchased from Ksiazka.uk. You must notify us in writing within the ‘cooling off’ period of fourteen working days of receiving the goods, beginning the day after you receive the goods. You must return your purchase to us and are entitled to a refund of the purchase cost of the goods under the conditions below.
You must notify us in writing, via our email ksiazka@ksiazka.uk of your ‘cancellation’ of your order and return the goods to us within 21 working days of the delivery of your order.
2.5. Order Cancellation
You will then be given a refund of the cost of your goods (and any original postage costs you incurred, if applicable), providing the goods returned are in their original condition and you have taken reasonable care of them whilst in your possession. By including a copy of the original receipt or delivery note this will speed up the processing of your return in our systems. Any cost (return cost) incurred to post the goods back to us will not be refunded to you and is your sole responsibility.
If we delivered the item to you in error or the item is damaged or defective then the cost of return will be met by us and must be accompanied by a return postage receipt. The cheapest way of posting the item is preferred by us and we would not refund any excessive posting expenses like using the courier or special delivery instead of second class Royal Mail.
2.6. Delivery
We deliver the goods ordered by you to the address you provide at the time you create your order on our website. Delivery will be made in accordance with the information on the order pages at the time of placing the order. We are not liable for any delay caused by the unavailability of you to accept the delivery. If there has been a delivery attempt made it will be your responsibility to contact the post office or courier company as soon as possible to arrange collection or re-delivery.
Delivery times are estimated and dependent on availability, printing processes, third party stock dates and delivery companies. The parcels are sent with Royal mail 48 or 24 or DPD- next day delivery (with the exception of Northen Ireland where the service is DPD 2 days). Please note that there may be a seasonal variant to standard times pending postal and courier service workloads. Ksiazka.uk will not be liable for any postal disruption outside of its control.
2.6.1 Non Delivery
In the event that a dispatched item(s) is delayed or assumed lost in transit we cannot offer to replace or refund until:
- 14 business days after dispatch if the item was sent via ‘standard’ post
- 5 business days after dispatch if the item was sent via DPD
Ksiazka.uk will hold no liability or responsibility to you unless you notify us within a total of 30 days of the date on which the goods were dispatched to you.
If you notify a problem to Ksiazka.uk, in writing or via e-mail, under this condition we will rectify a shortage on delivery or replace or repair any goods that are damaged or faulty; or refund to you the amount paid by you for the goods in question to the original payment method.
2.6.2 Cancellation by us
We reserve the right to cancel the contract between us if, for example:
- We have insufficient stock to supply your order within 30 days
- One or more of the goods you ordered was listed at an incorrect price due to typography errors or an error in the pricing information received by us from our third party suppliers
2.7. Governing Law
These Terms and Conditions and any separate agreements whereby we provide you shall be governed by and construed in accordance with the laws of United Kingdom.
3 Title and Risk
You become the owner of the goods you have ordered when we have received cleared funds in full payment for the goods. Once goods have been delivered to you they will be held at your own risk and we will not be liable for loss, damage or destruction.
4 Force Majeure
Every effort will be made to carry out purchase requests and delivery of goods but Ksiazka.uk shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so, or defect or damage caused in delivery that is caused by any event or circumstance beyond its reasonable control, including, without limitation, strikes, pandemic, lock-outs and any other industrial disputes, breakdown of systems or network access, flood, fire, explosion.
